1. Acceptance of Terms
By installing, accessing, or using Smart Dedup ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.
2. Description of Service
Smart Dedup is a monday.com marketplace application that provides intelligent duplicate detection, comparison, and merging capabilities for monday.com boards. The App operates as a Board View within the monday.com platform.
3. Account and Access
- You must have an active monday.com account to use the App.
- You are responsible for maintaining the security of your monday.com account.
- The App requires certain permissions (OAuth scopes) to function. By installing the App, you grant these permissions.
- An account administrator must approve the installation of the App.
4. Subscription Plans
- The App is available in three tiers: Free, Pro, and Enterprise.
- The Free plan provides basic duplicate detection with limited features.
- Pro and Enterprise plans are billed per seat per month through monday.com's billing system.
- monday.com handles all payment processing, billing, currency conversion, and tax collection.
- A trial period may be offered for paid plans. After the trial ends, the App reverts to the Free plan unless a paid subscription is active.
- We reserve the right to modify pricing and features with 30 days' notice.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the source code of the App
- Use the App to process data you do not have the right to access
- Overload the App or monday.com's API with excessive automated requests
- Resell, redistribute, or sublicense the App without written permission
6. Data and Privacy
- Your use of the App is also governed by our Privacy Policy.
- The App processes your board data client-side and does not store it externally.
- You retain full ownership of your data at all times.
- We do not access your data beyond what is necessary for the App to function.
7. Merging and Data Modifications
- When you merge duplicate items, the App updates one item's values and archives the other through the monday.com API.
- Archived items are not permanently deleted and may be restored.
- The App provides an "Undo Merge" feature that recreates archived items with their original data.
- You are solely responsible for reviewing and confirming merge operations. We recommend reviewing duplicate pairs before merging, especially when using auto-merge or bulk merge features.
- We are not liable for data loss resulting from merge operations that you initiated or approved.
8. AI Features
- The optional AI semantic matching feature sends limited item data to the Google Gemini API for analysis.
- AI results are advisory and should be reviewed by a human before taking action.
- We do not guarantee the accuracy of AI-generated duplicate assessments.
9. Intellectual Property
- The App, including its code, design, algorithms, and documentation, is our intellectual property.
- Your monday.com data remains your property at all times.
- We grant you a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will detect all duplicates in your data
- The App will be error-free or uninterrupted
- Duplicate detection results will be 100% accurate
- The App will be compatible with all monday.com configurations
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from these Terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.
12. Termination
- You may stop using the App at any time by uninstalling it from your monday.com account.
- We may suspend or terminate access to the App if you violate these Terms.
- Upon termination, your stored preferences will be removed. Your monday.com data remains unaffected.
13. Communication
By installing the App, you agree to receive:
- In-app notifications about duplicate detection (when enabled in Settings)
- Important service announcements (security issues, major changes)
We will not send marketing emails unless you explicitly opt in.
14. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes through the App or via monday.com's notification system. Continued use of the App after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from these Terms shall be resolved through arbitration or in the courts of Casablanca, Morocco.
